Terms of Service
These are the rules for using Credplate. We kept them short and plain, so please read them. If anything here is unclear, write to hello@credplate.com.
1. What Credplate is
Credplate is a place for restaurant people. You can train, take tests, keep a record of the tests you pass, and connect with other people who work in restaurants: a profile, a feed with posts and comments, and messages. Restaurants use it to write tests from their own menus and standards and to train their staff. Credplate is run by Credplate ("we", "us"), reachable at hello@credplate.com.
There are two kinds of account, and these terms cover both:
- A person signs up with their own email address (or Google), takes tests, and owns a profile that carries their passes from job to job.
- A restaurant is a workspace at
credplate.com/r/name, created by a person who becomes its admin. Admins and managers write tests, invite staff and see results.
What Credplate is not. We are not your employer, not a staffing agency, and we do not hire anyone or find anyone a job. We are not a government body or an official certifier. A pass on Credplate records that you passed one restaurant's test on one day. It is not a food handler card, a food manager certificate, an alcohol server permit, or any other license or certificate the law requires. If the law where you work asks for one of those, you still need it.
2. Who can use Credplate
- You must be 16 or older, and old enough to work in a restaurant where you live.
- One real person per account. Use your real name. No fake accounts, no shared accounts, and no accounts for somebody else. A restaurant may not sign up on a person's behalf or hold their account.
- Keep your information true. Your name, your jobs and anything else you add to your profile should be accurate.
- Keep your password to yourself. You are responsible for what happens under your sign-in. If you think somebody else has it, change it: that signs you out everywhere else. Then tell us.
3. Your passes are yours
A pass is a record that you passed a particular test at a particular restaurant on a particular day. It is stored on your profile with the restaurant's name as it was then. It stays there when you change jobs, when the restaurant renames itself, and when the restaurant stops using Credplate. A restaurant cannot edit a pass it gave. It can revoke one, and the record then shows that it was revoked; it can never quietly change one.
4. What you post
You own what you post: your profile, posts, comments, photos and messages.
You give us permission to show it. When you put something on Credplate, you give us a worldwide, free permission to store it, show it and share it with the people it is meant for, the way the service works. A post for your connections is shown to your connections. A post for your team is shown to your team. The public parts of your profile can be seen by anyone with the link, and by search engines, while your profile is public. This permission lasts only as long as we need it to run Credplate: it ends when you delete the content or your account, though copies can stay in our backups for a short time.
You are responsible for what you post. Only post what you have the right to share. Posts, comments, photos, profiles and messages must follow our Community Guidelines. We do not check everything before it appears, and we are not responsible for what other people post.
5. If you run a restaurant
If you are an admin or manager of a restaurant workspace, you and your restaurant are responsible for these things:
- Your training content. Tests, questions, menus, photos and documents belong to the restaurant that put them in, and keeping them correct and up to date is your job, allergens and food safety above all. Credplate can draft questions for you; check every one before your staff see it.
- Your staff's information. Use what Credplate shows you about your team only to train and manage your own team, and follow the laws that apply to you as an employer.
- Hiring. Who you hire, schedule, promote or let go is your decision. Credplate does not make it or recommend it.
- Tests for people you might hire. Use them lawfully and fairly. Never use them to treat people differently because of race, color, religion, sex, pregnancy, sexual orientation, gender identity, national origin, age, disability, or anything else the law protects.
- Talking about work. Staff may talk about pay, hours, tips and working conditions on Credplate. You may not use Credplate to punish anybody for that.
By uploading material you confirm you have the right to use it, and you give us the permission we need to store it, show it to your staff, and draft questions from it. That permission ends when you delete the material or close the workspace, except for the copies inside passes your staff already earned.
6. What you may not do
- Break the Community Guidelines.
- Sign in as anyone but yourself, or let anyone sign in as you.
- Upload material you do not have the right to use, or anything unlawful.
- Try to read another restaurant's workspace or a profile its owner has made private.
- Probe, overload or interfere with the service, use bots or scrapers, or try to get around a limit.
- Use the service to harass, discriminate against or spy on staff beyond what training reasonably needs.
- Send bulk, unwanted or advertising messages, or keep contacting somebody who has not accepted your invitation.
- Copy, resell or rebuild Credplate. The software, the design and the name are ours. You may use them for what Credplate is for, and not to build a competing service.
7. Reports and what we do about them
Anyone can tell us about a post, comment, profile or message they think breaks these terms or the Community Guidelines. A Report option is coming to posts, comments, profiles and messages; until it arrives, write to hello@credplate.com.
We may remove content, or suspend or close an account or a workspace, when it breaks these terms or the Community Guidelines, or when the law requires it. When we do, we will tell you what we did and why, unless the law or somebody's safety stops us.
If you disagree with a decision, write to hello@credplate.com and a person will look at it again.
8. Copyright
If you believe something on Credplate copies your work in a way that breaks your copyright, send a notice to our designated agent under the US Digital Millennium Copyright Act (DMCA):
Credplate, attention: Copyright Agent · hello@credplate.com
Your notice must include:
- your physical or electronic signature, or that of somebody allowed to act for the copyright owner;
- the copyrighted work you say is being copied;
- what on Credplate you say copies it, and where we can find it (a link is best);
- your name, postal address, phone number and email address;
- a statement that you believe in good faith that the use is not allowed by the copyright owner, its agent or the law; and
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are allowed to act for the owner.
When we get a complete notice, we take the material down and tell the person who posted it. If you posted it and believe it was taken down by mistake, you can send a counter-notice to the same address with: your signature; what was removed and where it was; a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification; your name, address and phone number; and a statement that you agree to the jurisdiction of the federal district court for your address (or, outside the United States, any district where Credplate may be found) and will accept service from the person who sent the notice. Unless that person tells us they have gone to court, we may put the material back after 10 to 14 business days.
We close the accounts of people who break copyright again and again. A notice or counter-notice that knowingly says something false can make whoever sent it liable for damages.
9. Paying for a restaurant
A person's account is free, always. A restaurant workspace is priced per location per month; the current price is on the pricing page. New workspaces get a 30-day free trial with no card required. If no card is added by the end of the trial, the subscription ends and nothing is charged.
Payment is handled by Stripe. We never see or store card numbers. Subscriptions renew monthly until cancelled; you can cancel any time from the Billing tab, and the workspace stays open to the end of the period already paid for. Adding or removing a location changes the next bill, pro-rated. We do not refund partial months.
If a payment fails, we email the workspace admins and keep the workspace open for seven days. If it is still unpaid after that, the workspace closes until billing is sorted out. Nothing about a closed workspace touches the passes its staff earned.
We may change the price with at least 30 days' notice by email to the admins. A change never applies to a month you have already paid for.
10. Availability and changes to the service
We aim to keep Credplate up around the clock and to tell you when it is not. We do not promise a particular uptime. We may change or add features, and we may retire a feature with reasonable notice. If we ever shut the service down, we will give at least 90 days' notice and a way to export your restaurant's content and your own passes.
11. Ending things
You can stop using Credplate at any time. A person can delete their account from Settings, or email hello@credplate.com from the address on the account and we will delete it within 30 days; the privacy policy says what deletion keeps and why. An admin can cancel a workspace from the Billing tab.
We can end your access if you break these terms, as section 7 says. If we end it for any other reason, we will give notice and refund any unused, prepaid time. Sections 4 and 5 (for copies already shared or inside passes already earned), 12, 13 and 14 still apply after an account ends.
12. No warranty, limited liability
Credplate is provided as it is. We do not promise that it is error-free or fit for any particular purpose, and we do not promise that a pass proves anything beyond what it says: that a person answered a restaurant's questions to that restaurant's standard on that day. We are not responsible for what restaurants, employers or other people do, including hiring decisions, or for what other people post. Credplate is not a substitute for any training or certificate the law requires of food-service workers.
To the extent the law allows, we are not liable for indirect, incidental or consequential loss, and our total liability to you for anything arising from the service is limited to what you paid us in the twelve months before the claim, or $100 if you paid nothing. Some places do not allow these limits, in which case they apply as far as the law there permits.
13. If someone makes a claim because of you
If someone brings a claim against us because of content you put on Credplate, or because you broke these terms or the law, you will cover our reasonable costs of dealing with that claim, including reasonable lawyers' fees. This does not apply to the extent the claim was caused by us.
14. Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute will be heard in the state or federal courts located in Travis County, Texas, and you and we each agree to that jurisdiction. If you live somewhere whose law gives you rights these terms cannot take away, you keep them. If a court finds part of these terms unenforceable, the rest still stands.
15. Changes to these terms
The version and the date at the top of this page tell you which terms are in force. When we make a change that matters, we tell you, and we ask you to agree again the next time you sign in or open Credplate. Small fixes, like a typo or a clearer sentence, we just make and update the date. Earlier versions are available on request from hello@credplate.com.
